A Utah judge has ruled that Tyler James Robinson, the 23-year-old man accused of killing conservative activist Charlie Kirk, will stand trial for murder after determining that prosecutors presented sufficient evidence for the case to proceed.
Judge Tony Graf issued the ruling on Tuesday following a preliminary hearing in which prosecutors and defence lawyers disputed the strength of the evidence against Robinson. The decision moves the high-profile case into the trial stage, where the prosecution will have to prove its allegations against the defendant.
Robinson is accused of shooting Kirk in the neck during a rally organised by the conservative youth organisation Turning Point at a college campus on September 10 last year. Kirk was 31 at the time of his death.
The defendant faces the possibility of a death sentence under Utah law if convicted of the murder charge.
“For the foregoing reasons and based off the record and parties’ submissions, it is hereby ordered that the defendant, Tyler James Robinson, is bound over for trial,” Graf said in court.
The judge’s decision came after prosecutors relied on digital communications they said connected Robinson to the killing. Among the evidence presented were video-game chats and text messages that prosecutors argued showed Robinson had killed Kirk because he had become “fed up” with what he described as the influencer’s spread of “hate”.
The defence challenged the prosecution’s case, placing particular emphasis on the DNA evidence investigators say links Robinson to the weapon used in the shooting. Defence lawyers sought to raise questions about the reliability and validity of that evidence, making it a central issue during the preliminary hearing.
The preliminary hearing was not a determination of Robinson’s guilt. Its purpose was to establish whether prosecutors had presented enough evidence for the criminal case to continue toward a full trial. Graf’s ruling means the court found the evidentiary threshold had been met.
Following Tuesday’s ruling, Robinson entered a plea of not guilty to the charges against him, according to US media reports.
The case has attracted considerable political attention because of Kirk’s prominent role in conservative American politics. He founded Turning Point, a right-wing youth organisation that campaigned for President Donald Trump during the 2024 election.
Kirk’s death sent shockwaves through the US political landscape and triggered widespread concern over political violence. His supporters regarded him as an influential conservative organiser and communicator whose profile had grown substantially through his political activism and public appearances.
Turning Point is now led by Kirk’s wife, Erika Kirk, who welcomed the judge’s decision as another stage in the family’s pursuit of accountability.
“Today’s decision, which comes nearly a year since Charlie was taken from us, marks an important step in our family’s pursuit of justice for him,” she said in a statement posted on X.
The shooting has remained closely watched because of the circumstances surrounding Kirk’s death and the political significance of the organisation he led. The rally was part of Turning Point’s activities, placing the killing directly within the environment of organised political activism.
Kirk had emerged as a prominent figure within a Christian nationalist movement that promotes traditional social values and has been criticised for positions described as intolerant toward diversity and LGBTQ communities.
His supporters viewed him as a powerful voice for conservative and Christian values, while critics strongly opposed his political messaging and the positions associated with the movement around him.
The prosecution’s presentation of Robinson’s alleged digital communications is expected to remain an important component of the case as it advances. Prosecutors contend that the messages provide evidence of Robinson’s alleged motivation and involvement, while the defence has sought to undermine the physical evidence connecting him to the shooting.
The dispute over DNA evidence could become particularly significant during the eventual trial. While prosecutors say the evidence links Robinson to the murder weapon, the defence has questioned whether the evidence is sufficiently reliable to establish his involvement beyond a reasonable doubt.
With the judge now ordering Robinson to stand trial, both sides will have the opportunity to present their cases in greater detail. The prosecution will be required to establish Robinson’s guilt through evidence presented in court, while the defence will be able to challenge the government’s witnesses, forensic evidence and interpretation of the defendant’s communications.
For Kirk’s family, Tuesday’s ruling represents a significant procedural step nearly a year after his death. For Robinson, however, the case remains an allegation, and his not-guilty plea means prosecutors must still prove the charges against him at trial.
The proceedings are likely to maintain national attention because of Kirk’s political profile, the circumstances of the shooting and the possibility of a death sentence if Robinson is ultimately convicted. The case now moves beyond the preliminary stage toward a trial that will determine whether the prosecution’s evidence can establish Robinson’s responsibility for Kirk’s killing.
